Tax advisory

A specific question deserves a specific, written answer

Pakistan's tax law changes every year through the Finance Act, SROs and FBR circulars. Before you sign a contract, price a product, pay a foreign vendor or restructure, a short written opinion can prevent a costly mistake.

Tax advisory is advice on a defined question. We read the relevant provisions of the Income Tax Ordinance, 2001, the Sales Tax Act, 1990 and the Federal Excise Act, 2005, together with schedules, SROs, FBR circulars and relevant case law, and apply them to your facts. You receive a written answer that sets out the facts we relied on, the law, our conclusion and any risks or open points.

Common requests include the tax treatment of a sale or purchase, withholding on a new type of payment, whether an exemption or reduced rate applies, the tax on transferring property or shares, and payments to or from non-residents under Pakistan's tax treaties. Non-residents can also apply to FBR for an advance ruling under section 206A, and we can help frame that application.

Good advice depends on good facts. Before we answer, we ask for the contract, invoices, correspondence or structure chart behind the question, and we confirm our understanding of the facts in writing. If a point is genuinely uncertain, because the law is unclear or FBR and the courts have taken different views, we say so and explain the options and the risk of each, rather than giving a confident answer the law does not support.

Tax advisory differs from our tax consultancy retainer, which provides ongoing support, and from corporate tax advisory, which focuses on company-level matters. For cross-border questions, we work with our international tax team.

The most valuable tax advice is usually given before the contract is signed. Afterwards, the options are fewer and the cost is higher.

FAQs

Tax advisory questions we hear most

Have a question that is not here? Send it to us on WhatsApp and we will reply the same day.

What is tax advisory?
Tax advisory is advice on a specific tax question, such as the tax on a transaction, whether to withhold on a payment or whether an exemption applies. We give a written answer that cites the law and explains any risks.
How is tax advisory different from tax consultancy?
Advisory answers defined questions for a fixed fee each. Our tax consultancy is an ongoing retainer for businesses that need regular support throughout the year.
Can I rely on a written tax opinion?
A written opinion shows that you took professional advice and sets out the reasoning. It does not bind FBR, which can take a different view, but it is a strong basis for your position.
What is an advance ruling?
Under section 206A of the Income Tax Ordinance, 2001, non-residents can apply to FBR for an advance ruling on the tax treatment of a transaction. We can help prepare the application.
Do you advise on sales tax as well as income tax?
Yes. We advise on income tax, federal sales tax and federal excise duty, and coordinate with provincial sales tax on services where relevant. See also sales tax advisory.
How quickly can I get advice?
Simple questions can often be answered within a few working days. Complex transactions take longer. We confirm timing before work starts.
Do you advise foreign companies?
Yes. We advise non-residents on Pakistani tax, including withholding on payments and treaty relief, and work with our international tax team on the foreign side.
How much does tax advice cost?
We charge a fixed fee per question or opinion, based on complexity. Your first consultation is free.
