US tax with the IRS

US tax follows you, and your LLC, wherever you live

The United States taxes its citizens and green card holders on worldwide income, and expects foreign-owned US companies to file even when they owe nothing. For Pakistanis with US income, a US LLC or family in the US, getting both countries' filings right matters.

Individuals file Form 1040, or Form 1040-NR if they are non-resident aliens with US income. US persons with foreign bank accounts above the reporting threshold also file an FBAR with FinCEN. Businesses file according to their structure: Form 1065 for partnerships, Form 1120-S for S corporations and Form 1120 for C corporations. A single-member LLC owned by a non-US person is generally a disregarded entity, but it still files Form 5472 with a pro forma Form 1120 to report transactions with its owner.

States add their own income, franchise and sales tax rules, and online sellers can create sales tax obligations in states where they have no physical presence. The Pakistan–US tax treaty and foreign tax credits help avoid double taxation, but only when both sides agree. Our US work is coordinated with our IT export tax and Pakistan tax teams.

Many foreign-owned LLCs we see have never filed anything with the IRS. The good news is that it can usually be brought up to date.
Common mistakes

Where US tax usually goes wrong

These are the issues we see most often with clients who have US obligations from Pakistan.

01

Foreign-owned LLCs that never file

A single-member LLC owned by a non-US person generally files Form 5472 with a pro forma 1120 every year, even with no income.

We file LLC information returns.
02

Wrong return for your status

Filing Form 1040 instead of 1040-NR, or the reverse, changes what is taxed and which treaty benefits apply.

We confirm your residency status.
03

Missed FBAR reporting

US persons with foreign accounts above the threshold must file FinCEN Form 114, separately from their tax return.

We include FBAR in your filing.
04

State obligations ignored

Many states charge franchise or annual taxes on LLCs and companies regardless of profit.

We track state requirements.
05

Sales tax nexus overlooked

Online sellers can owe sales tax in states where they have no office once they pass that state's thresholds.

We review your nexus.
06

Double taxation

Income taxed in both countries when the Pakistan–US treaty and foreign tax credits are not applied.

We coordinate both returns.

FAQs

US tax questions we hear most

Have a question that is not here? Send it to us on WhatsApp and we will reply the same day.

Does a foreign-owned US LLC have to file with the IRS?
Generally, yes. A single-member US LLC owned by a non-US person is usually treated as a disregarded entity and must file Form 5472 with a pro forma Form 1120 each year to report transactions with its owner, even in a year with little or no income. See our US LLC tax services.
When are US individual tax returns due?
For calendar-year filers, Form 1040 and Form 1040-NR are generally due on 15 April, with an extension available for filing, although not for paying any tax due. Different dates can apply to some non-residents and to people living abroad.
What is the difference between Form 1040 and Form 1040-NR?
Form 1040 is for US citizens, green card holders and resident aliens, who are taxed on worldwide income. Form 1040-NR is for non-resident aliens, who are generally taxed only on US-source income. Which one applies depends on your status and, for some people, days spent in the US.
What is an FBAR?
An FBAR is FinCEN Form 114, a report of foreign financial accounts that US persons must file when the combined balance of their foreign accounts exceeds the reporting threshold during the year. It is filed separately from the tax return and has its own penalties.
Do I need an EIN?
Most US businesses, including LLCs with foreign owners, need an Employer Identification Number to file returns, open bank accounts and work with payment platforms. We prepare the Form SS-4 application through our EIN assistance service.
Do I have to collect US sales tax?
It depends on where your customers are and how much you sell. Each state sets its own rules, and many require out-of-state sellers to register once they pass a sales or transaction threshold. We review your sales by state and register you where needed.
Can I be taxed in both the US and Pakistan?
It can happen unless relief is claimed. The Pakistan–US tax treaty and foreign tax credit rules in both countries are designed to reduce double taxation, but they need both returns prepared consistently.
How much do your US tax services cost?
Fees depend on the returns and states involved and the complexity of your income or entity. Your first consultation is free and you receive a written quote before any work starts.
